Banta, <br />Division Director <br />The Division has reviewed your application to dispose of non-coal waste at the <br />Golden Eagle Mine. At this time the Division has the following adequacy <br />concerns regarding the application. <br />1. Rule 4.11.4(2) requires the reclamation of the non-coal disposal <br />area to be completed when disposal is completed. This requires <br />covering the waste with a minimum of two feet of non-toxic material <br />and revegetating in accordance with Rule 4.15. Wyoming Fuel <br />Company has indicated that they intend to continue using the area <br />for storage. This presents a potential problem. The Division <br />requests further clarification on how Wyoming Fuel plans to resolve <br />this potential problem. <br />It is not clear from the narrative if topsoil had already been <br />stripped from the area or it is going to be stripped during the <br />disposal operation. If topsoil has not been stripped, the material <br />Wyoming Fuel intends to use for reclamation of the area (i.e. as <br />topsoil substitute) will need to be tested to determine its <br />non-toxicity suitability.
