Long <br />Di.-isian Dircclor <br />Re: Review of Second Adequacy Responses to Technical Revision No. 79; West Elk Mine; <br />Permit No. C-80-007 <br />Dear Ms. Johnston: <br />The Division has reviewed Mountain Coal Company's (MCC's) responses [o the Division's <br />comments regarding the Technical Revision No. 79 application for the Refuse Pile Expansion <br />(RPE) area, new topsoil and subsoil stockpiles (North Soil Storage azea), and to widen the mine <br />entrance. Based olJ our review of your responses to the Division's second adequacy letter dated <br />May 2, 1997, the Division has the following remaining comments. The comments numbered <br />below correspond to the same numbered paragraphs contained in our original adequacy review <br />letter dated•April ~l, 1997. <br />2.04.7 t~IroloQV Description <br />2.04.7(1) Ground water Information <br />2. MCC's agreement to install additional piezometers within 60-days after the completion <br />of the installation of the liner for Phase I is acceptable to the Division. The Division <br />agrees with MCC's prohibition against the installation of piezometers penetrating the liner, <br />and concurs with MCC/Division consultation concerning their location. The Division has <br />no further concerns. <br />2.04.11 Fish and Wildlife Resources Information. <br />7. Response accepted. <br />
