The excavation, use and disposal of the material will occur on a parcel of private property owned and controlled by the same person, or on parcels of private property (owned and controlled by the same person) that aze contiguous. (Noncontiguous parcels shall be reviewed by the Board.) This exemption shall only apply to ranches and farmlands where the material is used on the parcel(s) to maintain agricultural operations. (Agricultural zoning of a pazcel(s) is indicative of the maintenance of agricultural operations.) This exemption shall not apply to residential or commercial developments or the prepazation of such lands for residential or commercial developments; or 2. Hand tools and lightweight, rubber-tired vehicles are used to extract and transport the material off site, and there will be only incidental surface disturbance; or 3. The excavation of material is part of a project that is subject to government review and permitting. The approved government permits ensure a beneficial use of the site affected by the material extraction.
