SEP-9-2004 15:19 FROM: BILL & JRNE JRNKE 1-970-728-6315 T0: 19702475104 P. 12 <br />BEFORE THE MINED LAND RECLAMATION BOAkil <br />STATE OF COLORADO <br />ORDER MODIFYING ORIGINAL FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE ALLEGED VIOLATION OF THE PATHFINDER DEVELOPMENT, INC., <br />FILE NO. M-1994-113 <br />THIS MATTER came before the Mined Land Reclamation Board on September 21, 2000 at Denver, Colorado <br />for hearing on a notice of alleged violation pursuant to § 34-32-124, C.R.S. Scott Smith appeared on behalf of <br />Pathfinder Development, Inc. Steve Shuey appeared on behalf of the Division of Minerals and Geology. The <br />Board issued its findings of fact, conclusions of law and order on October 12, 2000. <br />The $oard received informaticn regarding a factual mistake in the Board's order, and decided to consider a <br />modification of the order, absent any objection by the parties, Pathfinder Development, Inc. and the Division of <br />Minerals and Geology. The parties received notice of the reported error, and had the opportunity to respond. <br />The Division has requested that the Board approve a modificaton of the Order to correct the error. <br />This request came before the Boazd during its January 24 and 25, 2001 meeting at Denver, Colorado. The <br />Board, having considered the request for modification, and been otherwise fully informed in the premises, <br />hereby <br />ORDERS <br />that Finding of Fact No. 12 of the Board's October 12, 2000 Findings of Fact, Conclusions of Law and Order <br />shall be revised to the following form: <br />12. Mr. Janke testified that his property suffered damage as a result of past pipeline breaks.
