The Division is looking to resolve these issues, propose to renew the Eagle permit <br />and finalize the findings document by February 28. 1994. Submission of the <br />requested information by Cyprus Empire prior to that date will facilitate the <br />process. Items that remain unresolved will be stipulated as conditions to the <br />permit with a 30 day period for the Division to receive CEC's responses. Beyond <br />this time frame the Division will have to consider these items as permit defects and <br />take the appropriate enforcement action. <br />CEC Response <br />Per our conversation of March 11, CEC will submit under separate letter a minor <br />revision request outlining the pertinent revised materials, and providing a copy of <br />the pages for permit insertion. <br />In relation to the submittal dates, stipulations, and 30 comment period, CEC will <br />submit any outstanding items within 90 days of the permit renewal, per our <br />meeting of March 1. If the Division's understanding of this differs, please advise <br />us as to what items the Division disagrees with. <br />DMG Concern <br />Please be reminded that the Division is awaiting receipt of Cyprus Empire Corp.'s <br />Annual Reclamation Report as required 2.04.13. <br />CEC Response <br />As previously discussed, this item requires further attention from both CEC and the <br />Division to address some concerns on both sides. It is CEC's preference to <br />handle this matter independent of the permit renewal process, and we will be <br />contacting the Division concerning a course of action on this matter. <br />Janet, your co-operation in this matter has been greatly appreciated.
