,, <br />SURFACE COAL MINIt7G LEASE <br />THIS AGREEMENT, made and entered into this 1st day <br />of August , 1983, by and between COLORADO & UTAH LAND <br />COMPANY, a Delaware corporation, whose address is Post Office <br />Box 316, Pueblo, Colorado 81002, hereinafter referred to as <br />'C6U,' and AMERICAN FUELS, IC7C., a Colorado corporation, <br />whose address is Post Office Box 31854, Amarillo, Texas 79120, <br />hereinafter referred to as 'American Fuels'; <br />v, r m ,i n n n n m n_ <br />WHEREAS, American Fuels is desirous of obtaining the right <br />and license to mine coal by surface mining methods on certain <br />lands described below; and <br />WHEREAS, C&U is agreeable to entering into a lease with <br />American Fuels on the terms and conditions hereinafter set <br />forth. <br />NOW, THEREFORE, in consideration of the payments of royalty <br />herein specified and the due and proper performance of all con- <br />ditions and covenants herein contained, C&U, as Lessor, does <br />hereby demise and lease unto American Fuels, as Lessee, the <br />lands hereinafter described, situate, lying, and being in the <br />County of Huerfano, State of Colorado, for the purpose of strip <br />mining and appropriating the coal from the following described <br />lands, to wit: <br />T. 29 S., R. 65 47. of the 6th P.M. <br />SW 1/4 Sec. 19, excepting the surface <br />of 2.63 acres conveyed to W. S. Thomas on <br />10/15/30, 20 acres conveyed to A. M. Pryor <br />on 9/3/09, Bk. 76, Pg. 295, and 3.25 acres <br />wherein the oil, gas and mining rights are <br />reserved by the D&RGW Railroad Company in <br />former R/w Bk. 288, Pg. 256, containing 140 <br />acres more or less <br />T. 29 S., R. 66 W. of the 6th P.M. <br />E 1/2 Sec. 24, containing 320 acres more or <br />less, <br />together with the right to use as much of the surface thereof <br />as may reasonably be required in the exercise of the right to <br />
