Th~reaiter, thy <br />License shall immediately and. automatically terminates <br />without prior notice or compensation to LieM Upon such <br />termination or at any time thereafter in the future, however, <br />Lien shall have a right, at Lien's sole expense, to construct <br />a second or "double" track parallel to the present Sour in <br />appro:timately the location indicated on Exhibit "A" by blue <br />lines to enable Lien to ship rock from Section I without <br />recourse to the Loading Site or that portion of the Spur <br />contiguous to it or any extension of the present Spur. <br />Although Holly does not guarantee Lien the opportunity to <br />construct such second track (the parties recognizing that <br />• service to such second track would be at the election of the <br />Railroad, which Ho11y may not compel), Holly will do nothing <br />to impede Lien's constructing and securing service upon such <br />second trac4: and shall cooperate with Lien in any reasonable <br />way, which does not cost or embarrass Ho11y, in negotiating <br />an agreement wrth the Rarlroad to accomplish the foregoing. <br />5.
