Long <br />Division Direclor <br />Re: Rimrock Mine (Permit No. C-89-074) <br />Permit Renewal No. Ol <br />Dear Supervisor: <br />Pursuant to Title 33, Article 34, Paragraph 3, of the Colorado Revised <br />Statutes, the Division of Minerals and Geology hereby issues notice that on <br />April 6, 1995, an application for renewal of a valid, existing permit to <br />conduct coal mining operations, Permit No. C-89-074, by Rimrock Coal Company, <br />c/o Landmark Reclamation, Inc., 4901 South Windermere Street, Littleton, <br />Colorado 80120, was deemed complete for the purposes of filing. All reviews <br />and comment periods as provided in the Act and Regulations promulgated <br />thereunder initiate from this day of filing. <br />The applicant proposes to continue conducting reclamation operations at the <br />Rimrock Mine, which is located approximately three miles east of Trinidad, <br />Colorado, and is described as follows: <br />N 1/2 of Section 29, Township 33 South, Range 63 West <br />of the 6th P.M., in Las Animas County. <br />The above-mentioned tract of land is shown on the USGS 7.5 minute Quadrangle <br />map of Trinidad East. <br />In order for us to approve this renewal application, we are required to affirm <br />that the original finding that "the activities would not affect the continued <br />existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats as determined under the <br />Endangered Species Act of 1973..." remains valid. We request your review and <br />recommendation pursuant to this finding, as well as your evaluation of the <br />continued validity of the projections and assumptions of the mining and <br />reclamation plan which relate to federally protected wildlife species. <br />Applicable sections of the permit application are enclosed. Please advise us <br />if you require additional information. <br />In order for us to comply with regulatory time frames, we request that <br />comments be submitted to the Division of Minerals and Geology at the above <br />address by 5:00 p.m. on June 5, 1995. If no comments are received by this <br />date, we will proceed on the assumption that your agency has no concerns with <br />or objections to the applicant's proposal. <br />
