UttanY <br />DNision Director <br />Natural Resource TrusOCn <br />Under most circumstances, the following activities would not fall <br />within the definition of the term "mining": <br />1) The excavation, use and disposal of the material will occur <br />on parcels of private property, owned or controlled by the <br />same persons. The exemption also includes material <br />extracted from ranches or farmlands and used on the <br />property to maintain agricultural operations; or <br />2) Hand tools and lightweight, rubber-tired vehicles are used <br />to extract and transport the material off site, and there will <br />be only incidental surface disturbance; or <br />3) The excavation of material is part of a project that is subject <br />to government review and permitting. The approved <br />government permits ensure a beneficial use of the site <br />affected by the material extraction.
