<br />Memo to Christine Johnston <br />Mountain Coal T.R. 69 Adequacy <br />gage 4 <br />Reclamation Plaa <br />Mountain Coal seems to have overlooked the requirement for the <br />inclusion of a reclamation plan for the proposed disturbance as a <br />portion of the application. Rule 4.14.1(e) does exempt underground <br />mines from the need to return all excavated material to the portal <br />bench. However, all highwalls and depressions must be eliminated. <br />Therefore, the operator will have to provide a reclamation plan <br />which demonstrates that the highwall faceup of the fan bench can be <br />eliminated and that all surplus material has been placed in a fill <br />designed and constructed in accordance with the requirements of <br />Rules 4.05, 4.06, 4.09 and 4.15.
