RE: C-JD-~ I\4ine, DMG Reclamation Permit No. M-77-245, status of enforcement action
Dear \4s. Blake;
As }'ou know, the Formal Public Hearing for the enforcement action regarding failure to provide
adequate financial warranty has been continued to the Febtvaly 2~-26, 1998 monthly Board
Meeting. The hearing \\ill be held in Room 315 of 1313 Sherman Street, Denver, Colorado,
begitsning at 9:G0 a.tn. or as soots tlsereafrer as the matter can be considered.
In order to resolve this enforcetnetlt action, the current state reclamation permit ]solder (Blake
Mining Co.) will need to complete one of the following options prior to the scheduled hearing
date:
1) Provide to the Colorado Division of Minerals and Geology (`DMG") an acceptable
financial warranty in the amount of S21,S65.00. The form ofthe financial warranty
instrument must fully conform \vith one of the various types of bond instruments currently
acceptable to the DMG, namely: a) Check for Deposit in State Treaswy; b) Certificate of
Deposit; c) Irrevocable Letter of Credit; or d) Corporate Surety. In addition, the financial
warranty must be submitted along with properly filled out and executed DMG bond forms
for the type of bond instrument selected. Also, the financial \~.-arranty must be submitted
to, reviewed, and accepted by the DMG prior to the date of the hearing. In order to
provide DMG staff with sufficient time to review the financial warranty submittal, you will
need to submit the financial \varranty materials several dam prior to the scheduled hearino

to obtain the appropriate bond forms. .
In the event the DMG permit holder wishes to pursue having the DMG accept a Dept. of
Ener~ry ("DOE") bond in lieu of a DI\1G bond, the permit holder .a-ill need to provide to
the DI\1G, prior to the hearing, sufficient written verification from the DOE that: a) The
entire ] 0 acre area comprising the D;\IG reclamation permit is fully covered by a valid
DOE lease; b) The current DOE lease holder is the same entity as the DMG reclamation
