The activity involves installation of support piers and box culverts for <br />four (4) ditch crossings and the St. Vrain Creek bridge while the water is low in the winter. <br />No mining activity of any kind will take place at this time (i.e., no topsoil stripping, overburden <br />removal, limestone mining, blasting, crushing, transportation of production rock, etc.). The <br />haul road will be a permanent feature, used as access to the property after mining and <br />reclamation. The existing permit includes no provisions for demolition or reclamation of the <br />haul road because it will remain in place as permanent access to the property. <br />Southdown wishes to comply with the conditions of Permit No. M-93-041 for this initial phase <br />of the project. <br />The permit conditions and our response to them follows: <br />No. 1: Cultural Resource Management Plan (CRMP) <br />A draft CRMP has been reviewed by the State Historic Preservation Office (SHPO). SHPO <br />made some minor comments and the final draft will be submitted in November, 1994. We <br />are meeting with SHPO on Thursday, November 17, 1994. We will ask SHPO to write a letter <br />to the Division stating they have no objections to the preliminary construction. No <br />archaeologic sites are present in the vicinity of the preliminary construction nor are any <br />predicted to be found in the subsurface. Minimal excavation will take place in the preliminary <br />construction phase. The ditches have some historic significance and the areas of the <br />crossings have already been photodocumented (as recommended in the CRMP). <br />No. 2: Black Footed Ferret Studv <br />The study has been completed and no ferrets were found. A letter from the project wildlife <br />biologist (Rick Thompson) reporting the findings has been previously forwarded to the <br />Division.
