i • <br />Roberts/M-77-407 adequacy <br />10/7/97 <br />page 4 <br />Details A and B, runoff control ditches and cobble discharge apron, respectively, should be <br />further described in the text of Exhibit E. Please describe how the ditches will be constructed, <br />their slope if any, plus maintenance. Please clarify whether there will be more than one discharge <br />apron and why (as the map shows) it is located on a ridge rather than in a gully. <br />The map depicts the pre-existing roads as truncated at the edge of the affected area, lout not the <br />fences. Please clarify whether these fences will, in fact, be reestablished at their form~sr locations, <br />or even be reestablished at all. <br />Exhibit G -Water Information <br />If the site requires a stormwater discharge permit, please provide the details of the coirunitments <br />made to CDPHE, for practices or structures, since they may involve enforceable permit conditions <br />with this Division also. This is requested due to the potential for offsite (downhill) di;;turbance, <br />and up to 70 or more acres of affected land draining to a common point. <br />Exhibit H -Wildlife Information <br />The present application is substantially different from the original plan in the 110 permit <br />application. Please obtain a reply from the CDOW based on their review ofthe current <br />application. Replies based on past application materials do not suffice. <br />Exhibit K -Climate Information <br />The Rules require submittal of information pertaining to "significant" climatic factors, which <br />should include the monthly distribution of the annual precipitation. <br />Exhibit N -Source of Legal Right to Enter <br />It is probably due to my limited understanding of the ]ease-purchase agreement, but I cannot find <br />the language in that document pertaining specifically to the lessee's right to enter for mining and <br />reclamation. Please direct my attention to that item, or provide such a statement, if ne<:essary. <br />Exhibit P -Municipalities Within aTwo-mile Radius <br />I am assuming that the hamlets of Lujane and Cedar Creek are not worth asking about. <br />Exhibit S -Permanent Man-made Structures <br />Please comment on the ownership of the fences (as depicted on the maps in Exhibits C .ind F), <br />especially those which appear to be outside of the land owned by Lazy A Corp.
