Box 670 <br />Hayden, CO 81639 <br />Re: Seneca II Mine (Permit No. C-1980-005) <br />Technical Revision No. 37 -Adequacy Review <br />Deaz Mr. Kazo: <br />The Colorado Division of Minerals and Geology (CDMG) has reviewed Seneca Coal <br />Company's (BCC's) responses to our adequacy questions for Technical Revision No. 37 <br />application, which contains responses to the CDMG's Midterm Permit Review adequacy <br />questions of August 17, 2004, as well as the Addendum to Midterm Review dated <br />February 10, 2005. The CDMG has the following remaining comments, which aze <br />numbered according to the original midterm review and addendum comments. <br />1. The response was adequate with exception of some problems noted with page <br />insertion into the permit document and pagination. Insertion instructions indicate <br />replacing existing pages 13-45 to 13-48 and 13-51 to 13-54 in Tab 13. Existing <br />pages 13-49 and 13-50 contain duplicated information and the remainder of Tab <br />13 (pages 13-54a to end) does not flow together with the revised pages. Please re- <br />paginate and resubmit pages 13-45 to the end of Tab 13 removing extraneous <br />information. Also please revise the first sentence of page 13-53 to indicate <br />"...13.5 miles of mine roads..." will be retained. <br />2. - 7. Responses accepted. <br />There is a typographical error on page 5 of Appendix 7-12.1. Exhibit 7-21 is <br />referenced. This should be referenced as Exhibit 7-23. <br />9.
