•
.~
'~

~( ..
will. maintain it afier•Enron is gone:
2) A second letter from Phil Jensen on July 26, 1993 states that both the Northern #1
pond and the pond at the refuse facility should remain because these Items have been
used and wl!! continue to be used in the hunting and fishing businesses which are
currently in place on the property. It is understood that he will maintain these items
for his business.
Regarding the two ponds at the Rienau site, I also believe that no further
documentation is needed for pond maintenance for the following reasons:
1) I have worked extensively with George Rienau over the past year in making the
ponds exactly the way that he has desired them. I have even used his suggested
contractors in doing the modification work. George himself did much of the work in .
placing rock, harrowing, planting and channel fabric installation.
2) We have two letters from George Rienau in which he states his desire that each of
the ponds be modified according to the approved revisions for each of the two ponds.
He was very specific about how he wanted the ponds and he fully understood that he
would be assuming responsibility of the ponds: He does not want any outsiders on his
property, as clearly evidenced by the number of times he has threatened DMG
personnel and Enron personnel if they entered the property.
3) During the final bond release inspection, Byron Walker asked George Rienau if he
was satisfied with the sites and George replied "Yes, it is as good as it ever will be
and it is about time to get rid of all these people out here". This was heard by many
people during the site visit. In other words, he will maintain his own property.
Susan, I hope that you can see your way to allow the existing information to suffice
for the maintenance regulation. It would be a cruel injustice to hold up the bond
release over such a thing. Please let me know as soon as possible. Due to past
problems in dealing with Rienau and Jensen, Enron has instructed me not to talk to
them regarding this item at this time in the hope that we can get it resolved without
upsetting them further. I appreciate your understanding on this matter.
Call if there any questions.
cc: Byron Walker
Susan Bulgawicz, Enron .
Chris Hannan; Enron
Sincerely yours,
~~
Greg Lewicki
Greg Lewicki and Associates
~~• a:~.,: ,.
.. .'•.y'..~ 1.
