On August 28, 2006, the Division of Reclamation, Mining and Safety received your request to reduce the acreage at
the Midway Pit, Permit No. M-1988-018. We have determined that the following information must be submitted to
complete the requirements of Rule 4.16 of the Construction Material Rules and Regulations and C.R.S.
34-32.5-117(5) of the Colorado Land Reclamation Act for the Extraction of Construction Materials (a copy of this
Rule and Statute are enclosed for your information):
4.16.1(2) The Operator shall include in the notice to the Office the names and addresses and phone numbers of
all owners of record to the affected land.
4.16.1(3) 1'he written notice requesting release shall be sent by Certified Mail and be separate from other types
of communication to the Office.
