Banta. <br />Division Director <br />September 10, 199C <br />Mr. Rod Gantt <br />1011 High View Road <br />Bayfield, CO 81122 <br />Re: Phase II Bona Release, Canadian Strip Mine, C-81-026 <br />Dear Mr. Gantt: <br />Wyoming Fuels Company has submittea a Phase II Bond Release application to the <br />Colorado Mined Land Reclamation Division (CMLRD) for topsoil replacement and <br />vegetation cover establishment per Rule 3.03.2(2). The bond release request <br />covers the 106 acres of reclaimed land at the 155 acre Canadian Strip Mine. <br />The property can be found on the USGS 7.5 minute quadrangle map entitled <br />Johnny Moore Mountain. The legal description follows: <br />Township 8 North, Range 78 West, 6th P.M. Section 10: SE1/4 NE1/4 NE1/4 <br />containing 10 acres; Section 11: W1/2 NW1/4, contains 80 acres; Section <br />2: Beginning at the point 1225 N 89 degrees 41'21"E from the NW corner of <br />the SW1/4, thence N 89 degrees 47'21"E, 100 feet, thence S 00 degrees <br />12'39"E, 1500 feet, thence SW to a point on the south section line which <br />is 1530 feet S 89 degrees 38'00" E of the SW corner of said SW1/4, thence <br />N 89 degrees 38'00" N, 1530 feet to the SW corner of said SW1/4 thence <br />N 00 degrees 01 '0s"W, 300 feet, thence N 40 degrees 44'00"E, 1250 feet, <br />thence NE to the point of beginning, contains 65 acres. The surface <br />owners are Ida Murphy, Dale Moore, James Kerr and the Bureau of Land <br />Management. <br />The Colorado Mined Land Reclamation Division will render a proposed decision <br />on the bond release request following a site inspection to assess compliance <br />with the approved reclamation plan. The inspection was held September 5, <br />1950, and a decision will be made by October 5, 1990. Your grandmother called <br />on September 5, 1990, to express concern about the bond release request. She <br />indicated that you were aware of her concerns and might be able to articulate <br />them a little more clearly. <br />Phase II Bond Release covers replacement of a minimum of 6" of soil over the <br />site and establishment of 90~ of the vegetative cover standard with 90% <br />statistical accuracy. In addition, the operator must prove that the site is <br />not contributing suspended solids to streamflow or runoff outside the permit <br />area in excess of pre-mining levels. The Division has done a number of <br />preliminary inspections this summer in support of this bond release <br />inspection. Results were summarized during the September 5, 1990 field <br />inspection and a general inspection was performed. <br />
