First Union National Bank issued on behalf of Western Fuels-Utah (WFU) a U.S. Treasury Note Safekeeping
Receipt No. CUSIP 912827Q62 on July 31, 1994 in the amount of $5,300,000.00 to the State of Colorado as
security for a coal reclamation bond for Permit No. C-81-018. The name of the corporation has been changed
from Western Fuels-Utah, Inc. to Blue Mountain Energy, Inc. (BME) as evidenced by the attached Articles of
Amendment to Articles of Incorporation of Westem Fuels-Utah, Inc.
Because of this name change BME is required to submit a coal reclamation bond form to the State of
Colorado Division of Minerals and Geology (DMG) in the name of BME which will replace the bond
currently in WFU's name. Enclosed is a copy of the completed bond form for an authorized representative to
sign and return to me. Enclosed for your reference is a copy of the original bond for Permit No. C-81-018.
The DMG also requires that First Union National Bank acknowledge the name change. Therefore, please
countersign this letter in the space provided below acknowledging this name change and return the letter to
me at your eazliest convenience.
