Dear Mr. Frei:
On May 9, 1997, the Division of Minerals and Geology approved the succession of operators from Albers Frei and
Sons, Inc. to Flag Resources, Inc. for the Goldman Cravel Pit. Flag Resources, Inc is now the permitted operator of the
Goldman Cravel Pit, and as such, is responsible for all provisions in Permit No. M-78-279, as well as those specified
in the Construction Rules and Regulations.
Enclosed is the Financial Warranty and Conditional Promissory Note for the Use with Deed of Trust and the Performance
Warranty you originally provided. Your obligation under Permit No. M-78-279 is released from your Deed of Trust and
your Performance Warranty under Permit No. M-78-279 is also release as of [he Division approval for the succession
of operators. Please amend your Deed of Trust currently on file to reflect the elimination of Permit No. M-78-279. After
the amendment is recorded, please provide the original recorded document to the Division.
