Aggregate Sourt:e <br />Permit No. M-77-193 <br />i am sending this letter in advance of the April 24-25 Bos~rd <br />Meeting. It is my desire that the Board shall abide by the state- <br />ment of November 28, 1995, in a certified letter to Tezak Heavy <br />Equipment Co., Inc., which says: <br />"Failure on the part of the operator, THECI, <br />to complete the specified actions within the <br />timeframe listed in this Board Order will <br />cause the permit amendment to be void." <br />• <br />In said Mined Land Reclamation Board's Notice.and Order, <br />Condition No. 2 - 3tormwater Management says: <br />". .. The revision. application must also <br />ensure that all designed structures will be <br />installed and functioning properly no later <br />than March 30, 1996 " <br />There are no stormwater management controls in effect. <br />I can find no reason for the Board to reropen the Permit Amend- <br />ment to Permit No. M-77-193. I note that any parties who were listed <br />for the November 16, 1995, Formal Public Hearing will be given an <br />opportunity to address the Board regarding Tezak Heavy Equipment's <br />request to modify the Nov. 27, 1995, Board order at the April <br />meeting. <br />I ask the Board to declare the 1995 Permit Amendment to No. M-77-193 <br />void.
