Banta. <br />Orv~sion Direolor <br />This letter is in response to your letter dated November 22, 1991 <br />expressing concerns with the above referenced technical revision. <br />In your letter, you objected to "any change of water flow from the <br />sedimentation pond" and requested that "all water be diverted back <br />onto our land as it was before mining". <br />The revision submitted by Sun Coal proposes modification of the <br />emergency spillway of the loadout sediment pond, as required by <br />recent changes in the Regulations of the Colorado Mined Land <br />Reclamation Board. An open channel spillway is proposed to replace <br />the closed spillway which exists now. Quantities and location of <br />pond discharge will not be significantly affected by the proposed <br />changes. Pond discharge will continue to flow into the Yampa <br />River, as proposed in Sun Coal's application. <br />The Division would be willing to review a proposal to reroute pond <br />discharge from the sediment pond if such a proposal were submitted <br />by Sun Coal. However, the Division has no authority to require <br />such a revision. Development of such a plan would be at your and <br />Sun Coal's discretion. I can only advise you to contact Sun Coal, <br />as the Division has advised you in the past (letter from Jeff <br />Clapton to you, dated May 4, 1989; letter from Fred Banta to you, <br />dated August 27, 1990; meeting with Jeff Clapton on the mine site, <br />September 5, 1990). <br />At this time, the Division is completing its review of technical <br />revision no. 11. When a proposed decision is made, notice of such <br />will be published in the Steamboat Pilot and a copy will be sent to <br />you. If you are opposed to the Division's decision, you have the <br />right to request a Board hearing on the matter at that time. <br />
