BRL has submitted an application for an updated NPDES permit. Please provide a copy to the <br />Division when it is obtained. <br />25. With the construction of the proposed coal mine waste disposal site no. 2, what will be the status <br />of the lower D-Gulch surface water monitoring station? <br />in the submittal dated February 11, 2004, BRL responded that there is no reason to move or <br />change the monitoring point and that the monitoring point will be active during the post mining <br />period. <br />From BRL's response, it is not cleaz to the Division whether or not the lower D-Gulch surface <br />water monitoring point will be functional during mining. Please clarify. <br />Reclamation <br />26. The Division has completed its review of the reclamation cost estimate. The estimate amounts to <br />$317, 098.00, which is $89,186.01 less than BRL's estimate of $406,284.01. Attached are the <br />Division's worksheets for the reclamation cost calculation, which consists of a summary sheet and <br />tasks 211 through 222. Please review the Division's estimate and inform the Division as to the <br />acceptability of the estimate. <br />BRL accepts the Division's reclamation cost estimate of $317,098.00. <br />General <br />27. What is the status of the air emissions permits for the construction and operation of the proposed <br />coal mine waste disposal site no. 2? Please provide copies of the updated air emissions permits <br />when they have been issued. <br />BRL has already applied for the au permits and will send copies to the Division when BRL <br />obtains them. <br />28. BRL has stated that they have applied for a substitute water supply plan with the Colorado <br />Division of Water Resources. When the plan is approved, please forward a copy to the Division as <br />part of the TR-30 adequacy review. <br />The Division has no further concerns. A copy of the substitute water supply plan was provided in <br />BRL's submittal dated February 11, 2004. <br />29. Attached is a copy of an adequacy response letter from the Colorado Historical Society (CHS) <br />dated November 25, 2003. In the letter, the CHS states that no known historical properties are <br />located at this location. If cultural resources are discovered during construction, work must be <br />stopped until a proper evaluation can be made. <br />No response was required. <br />30. In a letter dated November 14, 2003, the Division has requested from the Office of Surface Mining <br />(OSM) that they enter into a Section 7 consultation with the U.S. Fish & Wildlife Service (F&W) <br />
