1 <br />Midterm Review <br />Eagle 5 & 9 Mine (C-81-044) <br />This document presents the results of the Division's Midterm Revieā¢,v of Cyprus Empire <br />Corporation's Eagle 5 & 9 Coal Mine. This Midterm review was conducted to fulfill the <br />requirements of Rules 2.08.3, 2.06.2(10), 2.06.3(4), 2.06.5(3), 2.06.7(5), and 3.02.2(4). <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued, prior to its <br />midterm (2-1/2 years). Based on this review, for good cause shown, the Division may <br />require reasonable revisions or modifications of the permit provisions to ensure compliance <br />with the Act and Regulations. <br />Rules 2.06.2, 2.06.3, 2.06.5 and 2.06.7 require that experimental practices, mountain top <br />removal variances, variances from approximate original contour (AOC), and variances from <br />contemporaneous reclamation, respectively, be reviewed by the Division where applicable <br />during the Midterm Review. <br />Rule 3.02.2(4) requires that the Division review the amount of the bond and the terms of <br />acceptance of the bond every 2 1/2 yeazs. <br />This midterm review consisted of a detailed review of the Eagle 5 & 9 Mine permit <br />application and the Divisions findings of compliance for the 1994 permit renewal. The <br />Division also reviewed all subsequent revisions and stipulation respocues to ensure that all <br />permit commitments and conditions were being followed. Problems and observations from <br />past inspection reports were also considered. <br />Section I- History. of the Permit <br />The Eagle S & 9 Coal Mine is a lazge underground coal mining operation located in Moffat <br />County, approximately seven miles south of Craig, Colorado off State Highway 13. The <br />mine area encompasses 6,820 acres, of which 375 acres will be affected by surface <br />disturbance. <br />Coal mining has occurred in the Eagle mine since 1936. The present operations began <br />during the early 1970's. Empire Energy Corporation received irrs original permit on <br />September 2, 1983, for the Eagle Mine No. 5. On April 9, 1984, lEmpire Energy began <br />limited mining in the No. 9 Mine. The No. 9 mine was closed on August 10, 1984, and <br />Cyprus Empire Corporation added the Utah Tract and SA portal to the No. 5 Mine. A <br />permit revision (PR-Ol) was issued to Cyprus Empire on Apri124, 1987 that added the No. <br />6 Mine and included a change from room and pillar to longwall mitring. <br />
