is <br />The Rockcastle Company ("Rockcastle") hes submitted a request to <br />the Colorado Mined Land Reclamation Division for partial bond <br />release and bond reduction for the Grassy Gap Mine. <br />Rockcastle vas granted a mining and reclamation permit for the <br />Grassy Gap Mine (Permit No. C-81-039) on April 23, 1985 under the <br />Colorado Surface Coal Mining Reclamation Act (the "Act"), <br />S 34-33-101, g~ sea., C.R.S. The Grassy Gap Mine's precise legal <br />description follows: <br />Section 20: E 1/2 <br />SW 1/4 <br />Section 21: W 1/2 <br />Section 28: W 1/2 <br />Section 29: E 1/2 <br />Section 31: E 1/2 <br />Section 32: NW 1/2 <br />SE 1/2, E 1/2 NW 1/4 SE 1/4, E 1/2 <br />SE 1/4 <br />SW 1/4 <br />NW 1/4 <br />NW 1/4, NE 1/4, S 1/2 <br />SE 1/4 NE 1/4, NE 1/4 NE 1/4 <br />All Sections are located in Township 5N, Range 87W of the 6th Prime <br />Meridian. <br />Rockcastle is requesting Phase I and Phase II Bond Release, as well <br />as additional bond reduction for reclamation performed at the site. <br />Bond release and reduction activities are being requested in <br />conjunction with completion of reclamation activities at the Pit <br />No. 4, 5 and 6 areas. The current bond amount is 5572,000 pursuant <br />to a December 14, 1989, order of the CMLRB. Rockcastle hereby <br />requests release of 5522,000 of its performance bond pursuant to <br />S 34-33-125, C.R.S. Rockcastle is requesting Phase i bond release <br />for 337 acres reclaimed between 1979 and 1990. This includes the <br />areas associated with mining Pita No. 1, 2, 3, 4, 5 and 6. In <br />addition, Rockcastle requests Phase II bond release for 297 acres <br />reclaimed between 1979 and 1984. The Phase II bond release <br />excludes revegetation work performed at Pit 4 and the adjacent shop <br />area during 1990. <br />Bond release/reduction inspections will be performed by the <br />Colorado Mined Land Reclamation Division (CMLRD) on a monthly basis <br />between July and November, 1990. On the basis of these inspec- <br />tions, CMLRD may release liability and monies held under the bond. <br />CMLRD will publish its proposed decision on the release request <br />pursuant to 2 CCR 407-2, Rule 3.03.2 on a monthly basis. <br />Written comments, objections, and requests for a public hearing or <br />informal conference may be submitted to CMLRD within 30 days of the <br />last publication date of this notice at the following address: <br />Colorado Mined Land Reclamation Division <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />
