Per your request, I reviewed the Identification of Interest (Rule
2.03.4) and Compliance Information (Rule 2.03.5) for Coal Ridges
Midterm Review. I have the following comments;
Rule 2.03.4- Identification of Interest
1. In your memo, you requested an AVS Check for the Coal
Ridge Mine. AVS compliance checks are only required for
renewals, permit revisions, transfer of operators and new
permits. Since you are only doing a midterm review, an
AVS check is not necessary.
2. The Identification of Interest Section of the permit,
section 2.2, lists the owners and controllers of the
applicant. The pages date back to 5/9/91. Please have
the operator update the officers and directors if they
have changed since 1991.
3. Section 2.2.2 of the permit lists the Owners of Record,
and this dates back to 5/9/91. If any of the surface
owners, owners of coal to be mined or lease holders have
changed since 1991, please have the operator update the
permit pages.
Rule 2.03.5- Compliance Information
4. Rule 2.03.5(3) requires that a list of violation notices
received by the applicant be included in the permit
pages. The last violation in the permit pages date back
to August 4, 1989. Please update the list of violation
notices in Section 2.3.2 of the permit application.
