The San Miguel County Board of <br />Commissioners recently learned that the applicant has made significant amendments to the <br />pending permit. Furthermore, the sole legal access for at least two parcels of property located in <br />San Mrguel County is across that portion of the Hawks Pit which would be included in the <br />proposed expansion. It is imperative that the applicant negotiate appropriate arrangemertts with <br />the owners ofthe affected parcels to assure legal access to their properties prior to issuance of <br />any permit for the proposed expansion. <br />San Miguel County residents living in the vicinity of the Hawks Pit would be adversely impacted <br />by the applicaru's recent amendments which would eliminate earthen berms, which provide both <br />visual and auditory screening of the mining operations, as well as elimination of the proposed <br />setback of the mined area from the property line. Mitigation of the impacts associated with <br />proposed expansion upon adjacent properties indicate8 that your agency should not approve the <br />recently proposed application amendments which delete these highly beneficial measures. <br />San Miguel County remains concerned over the impact which the proposed water supply for the <br />expansion would have on other water users in the azea. Any expansion should be made expressly <br />contingent upon the applicant obtaining a court decree of suiHcient water rights to support the <br />proposed operations, together with appropriate well permits implementing those rights.
