Dear Mr. Green:
Pursuant to Title 33, Article 34, Paragraph 3, of the Colorado Revised
Statutes, the Division of Minerals and Geology hereby issues notice that on
February 4, 1994, an application for renewal of a valid, existing permit to
conduct coal mining operations, File No. C-81-018, by Western Fuels-Utah,
405 Urban Street, Suite 305, Lakewood, Colorado 80228, was deemed complete
for the purposes of filing. All reviews and comment periods as provided in
the Act and Regulations promulgated thereunder initiate from this day of
filing.
The applicant proposes to continue conducting underground coal mining
operations at the Deserado Mine located approximately ten miles east of the
town of Rangely. The permit area is described as follows:
Portions of Sections 1, 2, 3, 4, 10, 11 and 12,
Township 2 North, Range 101 West, and
Sections 21, 22, 23, and 26 through 36,
Township 3 North, Range 101 West of the 6th P.M.

The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map
entitled Rangely NE.
In order for us to approve this renewal application, we are required to
confirm that projections and assumptions in the permit remain valid and that
the operation is in compliance with the approved permit. We are requesting
your agency's evaluation of the renewal application with respect to the
continued validity of the original finding that "the proposed operations will
not adversely affect any publicly owned park or place listed on or those
places eligible for listing, as determined by the SHPO, on the National
Register of Historic Places, unless approved jointly by the Board and the
federal, State, or local agency with jurisdiction over the park or place".
No new surface disturbance is proposed with this permit renewal; therefore,
the updated permit pages have not been enclosed with this notification. If
