I have <br />identified the following potential deficiencies in the submittal. The concerns are worded for <br />forwarding to the operator, and this memo is located in your directory on the "m" network drive. <br />1. It does not appear that Colowyo Coal Company, L.P. (Colowyo) has obtained a permit <br />to discharge water from the Section 16 Pond. Prior to Division approval for construction <br />of the pond, Colowyo must provide a copy of a Colorado Department of Health permit <br />to discharge effluent from the pond. <br />2. Please revise or remove Table 1 of Section 8 of Exhibit 7 in the permit application. The <br />information in the table is no longer accurate for either the Prospect Pond or the West <br />Pit Pond. <br />3. The revised drawing of the Prospect Pond no conger shows the location of the Dam <br />Access Road culvert (12" CMP). Please revise the drawing to include the location of the <br />culvert. <br />The cover letter for the revision addressed a number of concerns which had been raised in a <br />DMG letter to Colowyo dated June 6, 1994. I believe Lary will be reviewing their response, <br />as the concerns originated during an oversight inspection conducted by he and Tony. <br />If you or the operator have questions or need additional information, let me know. <br />si.e~onivas.wr <br />
