July 22, 1999 • • <br />Mr. Jim Dillie <br />Page 2 <br />Item 3: Operator constructed a settling pond in the NE/4 Section 20 or NW/4 <br />Section 21-T12S-R62W to collect runoff from the southwestern <br />mining area. <br />The referenced settling pond is actually two separate and adjacent WPA era "Erosion <br />Control" dams. The smaller of the two structures is located in the NE/4 Section 20 and <br />the larger is located on the NE/4 Section 20 and the NW/4 Section 21 section line. The <br />smaller structure surface area is 0.2 acres with an estimated capacity of 1 acre-foot of <br />water and the larger structure surface area is 0.7 acres with an estimated capacity of 3 to 4 <br />acre-feet. Both structures are compacted earth fill dams, built on channel, with <br />constructed and revegetated spillways. The lazger structure has some armoring on the <br />upstream dam face. <br />These structures were not buik by the operator and are grandfathered structures. ROBCo <br />is the owner of both structures and requests that these structures remain. ROBCo, in <br />conversations with the State Engineer, is unaware of any permit requirements for these <br />structures. <br />If there are any questions, or I may be of further assistance, please contact me.
