J <br />brass are also present downstream from the reclaimed mine area. Examination of the aerial <br />photos indicates a high likelihood that the location of the Apex Mine was dominated by willows <br />and trees with grass in between the trees, much like the upstream area is today. <br />The recent submittal contains a letter from the landowner, which states that prior to any <br />disturbance from mining, the Apex No. 2 yard area "was primarily thick willows, which were not <br />suitable to any type of special agricultural use". <br />I cannot locate any information in our findings, the Apex Permit or in the aerial photographs to <br />contradict this statement. Having reviewed all of the available information, it appears that the <br />parcel of land at the Apex No. 2 yard was never of sufficient size or inherent productive potential <br />to support significant agricultural activities. Based upon this conclusion, it seems appropriate to <br />find that the parcel is not an alluvial valley floor, in accordance with 2.06.8(3)(c)(ii)(A). <br />Cc: Dan Mathews <br />
