Walther <br />Executive Director <br />Michael B. Long <br />Division Director <br />Listed below aze remaining adequacy review comments on the above-captioned amendment <br />application. The revised decision date for your application is May 13, 2002. Therefore, these <br />remaining concerns must be resolved on or before May 13, 2002. Please be advised that your <br />amendment application may be deemed inadequate and may be denied on May 13~ 2002 unless <br />the following adequacy review items are addressed to the satisfaction of the Division. <br />6.4.1 EXHIBIT A - Leeal Description & Location Mau <br />1. The applicant indicates the legal desription of the 2.5 acres to be removed has been added to <br />Exhibit A and that Exhibit B has also been updated to reflect the removal of the 2.5 acres. This <br />iriformation was not included in the Apri19, 2002 submittal. Please provide if available. Also, <br />in order to accommodate your request to eliminate the 2.5 permitted acres from the permit area <br />and any future reclamation responsibility, you will need to submit an official request for an <br />acreage reduction of 2.5 acres in accordance with the requirements of Rule 4.16.1 (please see <br />attached copy). The Division will approve your request upon receipt since the 2.5 acres is <br />undisturbed by mining activities. As an alternative to this procedure, you may submit a revised <br />Page 1 of the 112 Amendment application form to indicate that a total of 52 acres will be <br />permitted under the terms of this amendment request. Following approval of the amendment <br />request, you may submit an official request for an acreage reduction of 2.5 acres. Please respond. <br />
