.~ <br />Mr. Robert Stack <br />April 22, 1997-Red Canyon Appl. <br />Page 5 <br />20) Rule 6.4.8 requires the submittal of an updated Exhibit H, since the existing <br />exhibit does not address the presence of the Mexican Spotted Owl. <br />21) Rule 6.4.9 requires you to submit an updated Exhibit I, since the existing exhibit <br />only applies to the "old quarry area" and does not address the general type, <br />thickness and distribution of soil nor the suitability of topsoil (or other material) <br />for establishment and maintenance of plant growth over the rest of the proposed <br />affected land. <br />22) Rule 6.4.12 states that reclamation costs will be determined upon approval of the <br />amendment application. <br />23) Rule 6.4.13 requires you to provide a list of all the other permits and licenses <br />necessary to conduct the proposed mining and reclamationoperation. For instance, <br />Fl you may need a Stormwater Management Plan permit from the Department of <br />V Public Health and Environment (Department of Health)-Water Quality Control <br />Division. <br />., 24) Rule 6.4.19. The power line on the west side of the existing permit is considered <br />a manmade structure, so, therefore, you need to comply with the requirements of <br />Exhibit S. <br />25) Rule 6.5(1). On asite-specific basis, an applicant shall be required to provide a <br />geotechnical evaluation of all geologic hazards within or in the vicinity of the <br />affected lands that may be de-stabilized or exacerbated by mining or reclamation <br />activities. Specifically, the dolomite beds appear to be underlain by a layer of <br />` shale (at the granite-dolomite contact) that may act as a failure surface, if exposed <br />to the elements and the toe of the dolomite layer is undercut by mining. A massive <br />slide could occur, if the dolomite is not mined properly. <br />26) Rule 6.5(4). At sites where blasting is part of the proposed mining or reclamation <br />plan, the applicant shall demonstrate, through appropriate blasting, vibration, <br />geotechnical, and structural engineering analyses, that off-site areas will not be <br />adversely affected by blasting. Please provide sufficient information to <br />demonstrate that the air and ground vibration thresholds are well within the <br />standards set by the Office of Surface Mining and the U. S. Bureau of Mines. <br />Pursuant to Rule 1.8, your response will constitute an amendment to your application. <br />If necessary, within five (5) working days after receiving the amendment filing, the <br />Division shall set a new date for the consideration of the application. Also, a copy of the <br />amended filing must be submitted to the County Clerk and Recorder (of the appropriate <br />county) and an affidavit or receipt demonstrating that the Clerk and Recorder received <br />the amendment must be filed with the Division. <br />
