Bond Release Application No. 2 (5L-2)
Deaz Mr. Nettleton:
We have received your application, proof of publication, and copies of written notices concerning bond
release at the Eagle No. S and 9 Mines. Our initial review indicates that all preliminary items required by
Rule 3.03.2(1) regazding bond release applications and contents, have been submitted. Thus, your
application has been deemed complete for the purposes of filing on October 20, 2004. All review and
comment periods as provided in the Act and the Regulations promulgated thereunder initiate from this date
of filing.
The staff is currently reviewing your bond release application to detemune whether the items you have
submitted are adequate in terms of meeting the requirements of the Act and Regulations. Several items the
Division has identified that BTU-Empire Corp. (formerly RAG-EC) need to resolve include:
BTU-EC (RAG-EC) states that the landowner notification list was updated from the PAP and
Moffat County Assessors office. Several owners not found in the PAP, Wendalyn Crawford,
Robert and Jennifer Schriener Dunn, William and Faye McKune, and Robert and Ronald Steele,
were included in the adjacent property owner notification list. Verifying RAG-EC's list of
surface and coal landowners with the county assessors list is a recommended action to assure the
all current landowners aze included in the notification. Please update the PAP to include the
above mentioned land or coal owners and assure these individuals aze noted on the appropriate
surface ownership or coal ownership maps.
2. BTU-EC (RAG-EC) updated land and coal owners in the PAP in Apri12004 with Minor
Revision No. 44. Though updated in the permit, the Division noted that outdated addresses were
used when BTU-EC (RAG-EC) sent notifications to Mr. Jeffery Herrick, Greeley Land and Coal
Company, and Mr. Robert A. Mitchell. Please notify these surface or coal owners using the
updated addresses provided in MR-44. The Division noted that BTU-EC (RAG-EC) had not
received "receipt cards" back from these addressees.
