This matter was presented in a hearing, after proper notice, before the
Colorado Mined Land Reclamation Board ("Board") on June 23, 1987, in Room 302
of the Garfield County Courthouse, Glenwood Springs, Colorado. The Board
conducted the hearing to consider objections to the Colorado Mined Land
Reclamation Division's ("Division") proposed decision to partially release
reclamation bond for the Blue Ribbon Mine.
A quorum of the Board: Davis C. Holder, (Chairman), Dennis Donald, Chris
Jouflas, and Margaret Winter was present during the entire hearing and
participated in deliberation and voting on the matter. The hearing was held
in accordance with C.R.S. 34-33-125(6) and (7) and 2 CCR 407-2, Rule 3.03.2.
A taped transcript was made of the hearing. Pursuant to the authority vested
in the Board by C.R.S. 34-33-125 and 2 CCR 407-2, Rule 3.03.2, the Board
hereby makes the following Findings of Fact, Conclusions of Law and Board
Order.
Findings of Fact
1. Blue Ribbon Coal Co. owns and operated an underground coal mine known as
the Blue Ribbon Mine. The mine is located in Section 2, T13S, R92W of the 6th
P.M.
2. Blue Ribbon Coal Co. developed an adequate reclamation plan and received
approval for this plan from the Division under the permanent regulatory
program after adequate notice was given.
3. Blue Ribbon Coal Co. commenced final reclamation on November 20, 1985 and
has completed required backfilling and grading operations in a manner which is
consistent with the approved final reclamation plan. Reclamation activities
completed include backfilling of the highwall and access road, covering and
stabilizing the mine bench, and smooth grading and stabilizing all areas.
Three sediment ponds remain to effect sediment control.
4. Blue Ribbon Coal Co. requested partial bond release for backfilling and
grading operations on November 6, 1986.
5. Proper notice and comment procedures were followed for consideration of
the bond release request by the D1vlsion. Exhibit I to this hearing details
the sequence of these procedures and is hereby included by reference.
6. The Division issued a Proposed Decision on March 20, 1987 to partially
release bond for backfilling and grading.
