Box 751 <br />Trinidad, Colorado 81082 <br />Re: Technical Revision, File No. C-055-82 <br />Dear Mr. Van Sant: <br />The Division has reviewed your technical revision application for <br />expansion of the refuse pile submitted July 21, 1933. <br />The Division is proposing to approve the application at this tune with <br />three stipulations. <br />The stipulations are as follows: <br />Stipulation No. l: <br />THE PERMITTEE SHALL COMPLETE A SITE-SPECIFIC SOPHISTICATED <br />MATHEMATICAL STABILITY ANALYSIS OF THE AMENDED CONFIGURATION <br />PROPOSED FOR THE COAL PROCESSING WASTE PILE. THE PERMITTEE SHALL <br />SUBr4IT THAT ANALYSIS, FOR REVIEW BY THE DIVISION, NO LATER THAN 90 <br />DAYS FOLLOWING APPROVAL OF THIS TECHfVICAL REVISIOfV APPLICATION. <br />THE PERMITTEE SHALL RESTRICT PLACEMENT OF COAL PROCESSING WASTE TO <br />THE TWO LOWER-MUST 50 FOOT THICK TERRACE BENCHES OF THE PROPOSED <br />AMENDED WASTE PILE, UNTIL THE DIVISIOfJ HAS APPROUED THE STABILITY <br />ANALYSIS AND CORRESPOiVDING DESIGN. IN THE EVENT THAT THE STABILITY <br />ANALYSIS DETERMINES THAT THE SLOPES OF THE PROPOSED AMEfVDED COAL <br />PROCESSING WASTE PILE WILL NOT ATTAIN THE REQUIRED MINIMUM STATIC <br />SLOPE SAFETY FACTOR OF 1.5, SUfJDANCE COAL COMPANY SHALL REDESIGN <br />AND RECOfVSTRUCT THE THEfV EXISTING EMBANKMENT TO COfVFORM 4lITH A <br />DESIGN SUBSEQUENTLY APPROVED BY THE DIVISION.
