AUG-29-2003 FRI 09 05 AM B B EXCAVATING FAK N0, 9709262344 F, 09 <br />course irrigation except as provided in Subarticle l.j. above. There <br />shalt be t+o categories of industrial water service as follows: <br />(1) "category A" industrial water service which is reserved for <br />those contractors who are existing customers for water from the Reservoir <br />or have previously used water service from the Reservoir, who are currently <br />operational, and who are unable to utilize Ruedi Reservoir as an <br />alternative source for water service. Such entities' entitlement to <br />Category A water service shall not exceed the quantities requested by those <br />entities on or before August 15, 1988. <br />(2) "Category B" water service which is available to all other <br />industrial contractors who are not covered in (1) above. <br />m. "Operation, Maintenance, and Replacement" (OM&R) costs shall <br />mean those expenditures incurred in connection with the operation and <br />maintenance of the Reservoir excluding facilities used solely for <br />hydroelectric power production. Such expenditures shall include those <br />required to remedy conditions brought about by the ordinary use of the <br />Reservoir or to restore or replace components of the existing facilities <br />and shall not include expenditures to increase the Reservoir's capacity or <br />to enlarge the purposes for which it was originally authorized and <br />constructed. <br />n. "Standby charge" shall be that annual charge to reserve the <br />right for delivery of water annually pursuant to 5ubarticie 4.d. <br />6 <br />
