We understand the Division's concern that the new proposed phasing plan <br />appears to imply disturbance will increase as the phasing increases. However, the maximum <br />disturbance at any one time will not change from 149.92 acres, as stated in the current <br />permit. <br />The operator has chosen to change the mining direction. The new phasing plan simplifies <br />the operator's dtrection of the mining plan and is not representative of the maximum amount <br />of disturbance. Therefore, there should be no need to recalculate a new bond amount for <br />each of the four phases. <br />In your response letter you also mention the concern that a 3:1 reclamation slope will be <br />maintained with the use of a suction dredge. There is no difference in the slurry discharge <br />from a clamshell dredge end a suction dredge. That is, on the floating dredge whether it is <br />clamshell or suction, the fine material and the water are passed through a screen then <br />pumped into a slurry pipeline.
