The Ute Mine, operating under reclamation permit number M-1979- <br />221, requests a reduction in permitted acreage, to 42.37 acres. The released acreage will <br />operate under a new mining permit to be obtained by the property owner, Sedalia Land <br />Company. Although portions of the released acreage have not been reclaimed, Sedalia <br />Land Company will take on full reclamation responsibility of the released lands and has <br />filed a 112 reclamation permit application covering the released acreage. To allow the <br />Division of Minerals and Geology (DMG) time to accept the Sedalia Land Company 112 <br />permit application, Robinson Brick Company is waiving its right to a decision, regarding <br />the request for acreage release, for 30 days. <br />Please note that upon release of acreage by DMG, Robinson Brick Company will submit <br />a technical revision to permit M-1979-221 addressing changes to the mining plan, <br />reclamation plan and reclamation costs resultant from the decrease in permit acreage to <br />42.37 acres. Also, the technical revision will address changes in surface ownership, in <br />that, Robinson Brick Company now owns a portion of its' permitted acreage. <br />In preparing this request for permitted acreage reduction, a discrepancy in the original <br />permitted acreage has been identified. The permitted acreage was previously listed as <br />141.76 acres, however, the actual permitted acreage is 145.41 acres. This discrepancy is <br />due to the original permit being prepared at a time when surveying and drafting <br />techniques were not as accurate as present techniques. Therefore, the released acreage <br />totals 103.04 acres. A major portion of the released acreage (102.55 acres) is located <br />south of the revised Robinson Brick Company permit area. The remaining released <br />acreage consists of two small tracts (0.48 acre and 0.01 acre) located northwest of the <br />proposed revised Robinson Brick Company permit area.
