Box 68 <br />Craig, Colorado 81626 <br />Re: fey s Empire Corporation, Permit No. C-81-044, <br />Permit Renewal RN-03 <br />Deaz Mr. Mills: <br />The Division has reviewed your responses submitted in your letter of February 21, 2000, <br />and has the following comments. <br />Division's letter of 6/24/1998 regarding the pastureland reference area for No. 9 <br />Portal Area/Refuse Area (this reference area will be used only if the No. 9 Portal <br />Area/Refuse Area is not returned to cropland). <br />The Division's approval of the reference area will not become final until Stipulation <br />10 is complied with. Stipulation 10 reads: <br />Approval of the proposed dryland seedmix, species diversity <br />standard, and reference area for the No. 9 Portal area are withheld <br />pending Division inspection and evaluation of the proposed <br />reference azea during the 1997 growing season. <br />Although Stipulation 10 does not specify that the evaluation would require submittal <br />of "baseline" data, these data are necessary in order for the Division to complete the <br />evaluation. The data will support the final approval of the reference area by <br />confirming the appropriate diversity standard for the disturbed area, as required by <br />Rule 2.04.10.
