On <br />November 6, 2001, we also received a "Minute Order", from.the Las Anima's District Court (Case <br /># 2001 CV 00026; Tatum; Jim et.al. vs. Basin Resources, Inc.). This order appears to directly <br />pertain to the proposed drilling activities discussed in the tninor revision application.. ' <br />The submittal received October 29, 2001 refers to "two or more holes", while the court document <br />indicates approval for only one hole. We cannot take any action that may contradict a court order <br />or be construed by the court as intervention into a pending civil proceeding. Therefore, the minor <br />revision application is hereby deemed incomplete. <br />Please provide a revised application that clearly states that only one hole will be drilled, .as ordered <br />by the Las Animas district court. Please also amend the application to incorporate all project <br />implementation and reclamation details represented to the court. Finally, we aze accepting the . <br />referenced Minute Order to satisfy the right of entry provisions required by Rule 2.03.6(2) and <br />C.
