Rule 4.05.2(3)(a) requires the applicant demonstrate that sedimentation ponds and <br />treatment facilities are not necessary for the drainage to meet the effluent limitations of rule <br />4.05.2 and the applicable State and Federal water quality requirements for downstream receiving <br />waters. This demonstration is proposed within the application as a sample of the discharge from <br />the following significant rainstorm event. Reference is made to sediment fence structures that <br />are similar to the existing sediment fences structures currently in use on the mine. <br />Please supplement this proposed demonstration with asite-specitic sketch or design of the <br />sedimentation fence proposed.
