Long <br /> Division Director <br />Re: Bowie Mine No. l (Permit No. C-1981-038) <br />Technical Revision No. 39 (TR-39) <br />Coal Refuse in Portal Bench Reclamation <br />Deaz Mr. Bear: <br />We have received your application for a technical revision to your permit to conduct coal mining in Colorado. Our <br />initial review indicates that all preliminary items required by Rule 2.08.5(4) have not been submitted. Thus, your <br />application is incomplete for the purposes of filing as of September 14, 2001. <br />This determination of incompleteness is based on the proposal that 37,100 cubic yazds of run-of-mine coal <br />waste will be placed at the base of the portal bench reclamation fill. According to the TR-39 submittal, this <br />would result in a coal waste layer thickness of about 20 to 30 feet within the portal bench reclamation fill. The <br />Division believes that a fill that contains a significant thickness of coal waste essentially is a coal waste <br />stockpile. Therefore, additional information concerning coal waste stockpiles needs to be submitted before TR- <br />39 can be called complete. <br />The coal waste stockpile information needed for completeness is outlined in Rule 4.10, Coal Mine Waste <br />Banks. Rule 4.10 also references sections of additional roles as well. Such infotTnation should include, but not <br />be limited to, surface water collection and diversion drainage systems for the coal waste stockpile that aze <br />designed for the 100 year-24 hour event (Rules 4.10.3(2) and 4.09.2(7)) and an appropriately designed <br />underdrain system for the coal waste stockpile (Rule 4.10.3). In addition, an update of the probable hydrologic <br />consequences section of the permit application, as it relates to this proposed coal waste stockpile (Rule <br />2.05.6(3)(b)(iii)), would be needed. As a note, designation of a coal mine waste pile initiates the inspection <br />program outlined in Rule 4.10.2. <br />In accordance with Rule 2.07.3(1), you have the opportunity to amend your application [o make it complete. <br />If you have any questions, please contact me. <br />Sincerely, <br />J ep J.
