Cattany <br />Division DireROr <br />Natural Resource Trustee <br />On May 30, 2007 the Division of Reclamation, Mining and Safety approved the Amendment application submitted to the <br />Division on December 27, 2006, addressing the following: <br />Amendment to allow exposure ofgroundwater as permanent ponds onsite. <br />The terms of the Amendment No. 2 approved by the Division are hereby incorporated into Permit No. M-1994-005. The <br />conditions of the Division approval are noted below. Please note that all other provisions of Permit No. M-1994-005 <br />remain in full force and effect. <br />Stipulation No. 1 <br />Prior to exposing or using groundwater, the Operator must submit evidence to this office of having obtained <br />either a gravel pit or other type of well permit, as applicable. <br />Stipulation No. 2 <br />Prior to exposing or using groundwater, the Operator must present to this office proof of satisfying the <br />requirements of the Colorado Division of Water Resources concerning water wells within 600 feet of the permit <br />area boundary. <br />The revised estimated liability amount of $161,568 exceeds the $150,000 performance bond currently held. If you have <br />not already done so, please submit additional bond in the amount of $11,568.
