OSMRE-AFO agrees with the Division's proposed decision dated <br />March 9, 1988 that a 60-percent release of the present total <br />reclamation bond of $804,300 will reduce the bond by $482,580 to <br />$321,720 to be retained for Phase II and final reclamation <br />requirements. This final figure, which includes $45,000 of bond to <br />restore 2 acres of Prime farmland (if required under further rulemaking <br />- issue remanded by District Court Judge Flannery), appears to be <br />sufficient. The $482,580 release represents successful backfilling and <br />grading of the 60 acres permitted for disturbance at the loadout and 67 <br />out of 69 acres permitted for disturbance at the minesite. <br />All items of concern after AFO's December 17, 1987 site inspection have <br />been adequately addressed. Colorado's Inactive Mine Reclamation <br />Program, as documented in the proposed decision and in David Rolm's <br />letter of May 26, 1988 to AFO, has assumed reclamation responsibility <br />for the abandoned 1'12 portal and its associated PMDT system for acidic <br />drainage. IMRP also assumes maintenance responsibility, in accordance <br />with Mr. Holm's letter, ensuring that the new acidic treatment system <br />will not impact the reclamation recently completed on the minesite. <br />Proof of Publication of the Notice of Proposed Decision was received by <br />the Division on May 9, 1988 and was later forwarded to AFO. The May 9 <br />receipt date indicates that the Mined Land Reclamation Board, which <br />must approve the proposed release after public notification, has only <br />recently given its concurrence. The Board minutes for May have not yet <br />been received as part of the monthly mailing to AFO. <br />
