The <br />application has been deemed incomplete for the purposes of filing. As discussed below the <br />application should be resubmittedas a Technical Revision and should include a Public Notice. Thus, <br />the application has been deemed incomplete. <br />Per our telephone conversation on November 12, 1997 the Division is requesting that Mountain Coal <br />Company withdraw your MR-232 application and resubmit the application package as a Technical <br />Revision. The Division believes that a Technical Revision is applicable to the proposed mine <br />dewatering and treatment facility, because it would be a regulated structure or facility (see Rule <br />1.04). As we discussed during or telephone conversation, please be sure to include the following with <br />the application package: I) a geotechnical stability analyses for the proposed pond and treatment <br />facility or demonstrate to the Division that a geotechnical stability analyses is not necessary based <br />on existing information or other pertinent data, and 2) revise Windy Gap Process calculations for <br />potential evaporation from the proposed pond, if deemed appropriate. Additional adequacy review <br />items may be identified as the application package has not been formally reviewed. <br />Also include a Public Notice for the Technical Revision. The maps already submitted with the MR <br />do not need to be resubmittedat this time as they may require changes based on the Division's review <br />of the TR application package.
