Mr. Joseph Dudash - 2 - November 5, 2001 <br />For those maps that show the train loadout in addition to information that pertains to the <br />rest of the Bowie No. 1 Mine, please add a note to the map that states that the train <br />loadout has been transferred to the Bowie No. 2 Mine. <br />BRL-These maps have been removed or transferred according to the attached errata <br />sheet. <br />4. There are several permits and a U. S. Fish & Wildlife Service Biological Opinion <br />concerning water depletion that are attached to the Bowie No. 1 train loadout With the <br />transfer of the loadout to the Bowie No. 2 Mine, portions of or all of these permits may <br />need to be transferred administratively out of the Bowie No. 1 Mine permit and into the <br />Bowie No. 2 Mine permit application by the appropriate governing agency. One example <br />would be to remove the train loadout NPDESpermit discharge point from the Bowie No. <br />1 NPDESpermit. Please provide written verbcation from the appropriate government <br />agency that Bowie Resources has contacted the governing agency for each permit and <br />has resolved arty administrative transfer requirements. Please update the permit <br />application accordingly. <br />BR.L- We are currently revision the dischazge permit for Bowie No. 1 to move train <br />loadout NPDES permit dischazge point from the Bowie No. 1 dischazge permit to the <br />Bowie No. 2 dischazge permit. Copies of letters to the Colorado Department of Health <br />and Environment concerning air (Construction) permits and to the Colorado Department <br />of Transportation concerning highway access permits are included in this response. The <br />biological opinion still applies to Bowie No. 1, in part, and is therefore left in the Bowie <br />No. 1 permit application. <br />S. In Section 2.03.6 of Volume 1, please remove references to any deeds or leases that <br />pertain to the Bowie No. Mine train loadout and coal stockpile area and add them to the <br />Bowie No. 2 Mine permit application. <br />BRL- Revised pages for Section 2.03.6 of Volume 1 aze provided with this response to <br />remove references to deeds and leases pertaining to the train loadout and stockpile azeas. <br />6. As required in Rule 2.03.6(1), please provide a complete legal description of the new <br />Bowie No. 1 Mine permit boundary. <br />BRL-Anew legal description of the Bowie No. 1 Mine permit boundary is included in <br />this response. <br />7. In a format similar to the one used for Section 2.05 of the permit application, please <br />provide revised pages for Section 2.04 and Section 4.03.1, both found in Volume 1, that <br />explain that the train loadout and coal stockpile area have been transferred to the Bowie <br />No. 2 Mine. <br />BRL- These explanations appear on pages 4, 22, 23, 25, 40, and 41 of Section 2.05 and <br />on page 1 of Section 4.03.1. <br />
