Second Place <br />Lakewood, CO 80215 <br />Re: New Elk Mine (Permit C-81-012) Technical Revision No. 06 <br />Update and Modification of Drainage Plan <br />Dear Mr. Stout: <br />As you will note from the accompanying decision form, TR-06, as most recently <br />updated in your April 4, 1988 response, has been given partial approval. <br />Stipulations have heen attached to that partial approval specifying what <br />portion of the plan cannot he approved at this time and that the approved <br />portion of the plan is to be completed by June 1, 1988. This date was <br />mentioned in your letter to the Division of December 3, 1987. <br />In regard to the plan, it is understood and agreed by the fivision that WFC <br />must have some latitude in the actual implementation of the plan. The <br />Division, however, cannot approve those portions of the plan as proposed where <br />apparent violations of the rules or the approved permit exist. Specifically, <br />culverts are lacking in at least two instance where haul roads are crossing <br />ditches in the East Portal area, and there is no illustration of the ditch <br />required for drainage of the new access road to the RDA. When these concerns <br />are adequately addressed, full approval of the proposed revision can be made. <br />As for eliminating the need fora culvert in Ditch 3 by eliminating a portion <br />of the haul road system, that is acceptable if the Division receives and <br />approves a Minor Revision proposing that particular reduction of the haul road <br />system. <br />If you have any questions in regard to the above, please call. <br />Sincerely, <br />Jav~o, CS~•uQ~ <br />James C.
