b. the amount of $464,164 was calculated by subtracting the <br />retained amount of $50,000, the revegetation costs of $40,280, and other <br />associated costs of $17,556, from the total bond amount of $572,000. <br />3. Prior to any bond release, Rockcastle shall reduce the total <br />reclamation liability to below $446,680 by returning a certain number of cubic <br />yards of material to Pit 4. The requisite number of yards shall be determined <br />by dividing $125,320 by the "per yard amount". <br />4. In addition, the Division shall propose a decision for release of <br />$57,836 pursuant to the following schedule: <br />a. revegetation = $40,280 <br />b, road buttressing = 15,000 <br />c. pond reclamation = 40 <br />d, pit regrading = 2,516 <br />VI. CONVERSION OF CURRENT RECLAMATION BOND -- Prior to commencing <br />reclamation activities under this Agreement, Rockcastle may replace its <br />current $446,680 reclamation bond from a letter of credit to a collateral bond <br />in the form of cash, negotiable bonds or certificates of deposit in a form <br />acceptable to the Division pursuant to 2 CCR 407-2 Rule 3.02.4(2)(c). <br />-g- <br />
