• • Page 228 <br />Section 4.01,1 <br />120(2)(u) (8) Confinement of surface coal mining and reclamation <br />operations including, but not limited to, the location of spoil <br />disposal areas to lan ds within the permit area; and <br />102 (9) Conducting surface coal mining and reclamation <br />operations to insure that society and the environment are <br />protected from the adverse effects ofi sum operations and that <br />the ri ghts of surface landowners acid other persons with a legal <br />interest in the land or appurtenances thereto are fully <br />protected . <br />108 4,01.2 Authority.~~' <br />The Board has the authority to promulgate Rules pursuant <br />to the Act which set forth minimum performance standards and <br />design requirements for surface coal mining and reclamation <br />operations. / <br />104,105 4,01.3 Res ponsibil ity. <br />%, <br />(1) It is th'e" responsibility of the Board and the <br />Division to insure that the provisions of this Rule pursuant to <br />the Act are impl emented and enforced. ~ <br />120(1) (2) Any person con aucting coal exploration or surface <br />coal mining and reclamation operations under a permit issued in <br />accordance wifti these Rut es is responsible for meeting all <br />applicable p~~formance standards of this Rule. <br />4.02 SIGNS~AND MPRKERS <br />4.02.1 Spe ci fi cations . <br />~~~s and markers required by 4.02 shall: <br />,(1) Be posted and maintained by the permittee; <br />(2) 8e of uniform desigi throughout the operation that <br />e easily seen and read; <br />(3) Be made of durable material; and <br />(4) Conform to local ordinances and codes. <br />
