Cottony <br />Paonia, Colorado 81428 Division Director <br />Natural Resource Trustee <br />RE: Bowie No. 2 Mine, Permit No. C-1996-083, Bowie Resources LLC <br />Permit Revision No. 10, Expand B-Seam Mine Plan to the North, Third Adequacy Review <br />Dear Mr. Bear: <br />The Colorado Division of Minerals and Geology (Division) has finished its adequacy review of Bowie <br />Resources LLC's (BRL) responses dated December 28, 2006 to the Division's two adequacy letters dated May <br />18, 2006 and June 6, 2006 for Permit Revision No. 10 (PR-10). The following is the current status of the <br />issues: <br />Division's Adeguacv Review Letter Dated Mav 18, 2006 <br />Rule 2.03 <br />The Division has conducted an Applicant Violator System (AVS) computer check of the Bowie No. 2 <br />Mine permit. The recommendation is to "issue ". The Division will conduct similarAVSchecks at the <br />time of the Division's proposed decision and a[ issuance time for PR-[0. <br />No response was required by BRL. <br />Rule 2.04 <br />2. As indicated in the PR-10 application, BRL intends to instal[ additional ground water monitoring wells <br />in Hubbard Creeknorth ofthe proposed mine plan urea. The Division concurs, because ofthe northern <br />extension ofmining BRL will need to add additional downgradientgroundwatermonitoring wells to the <br />hydrologic monitoring plan. Please provide the Division with the proposed plan for well installation <br />prior to drilling and constructing the new wells. Also, please update the appropriate permit application <br />text, inclztding the completion summary table. Groundwater monitoring ofeach aquifer above, within <br />and, ifpotentially impacted, below the lowest coal seam to be mined will be required in accordance with <br />Rule 2.04.7(1). <br />BRL responded that a revision for new down gradient groundwater monitoring wells will be submitted <br />soon. However, there is a possibility that the wells won't be needed. BRL is in the process of <br />attempting to document that the drilling of the wells would be unreasonable when one considers <br />drilling costs versus benefit. <br />3. Because future mining will be extending northward past the current upgradient stream monitoring <br />locations on Hubbard Creek and Terror Creek, please propose new upgradient stream monitoring <br />locations for these two streams.
